Family sues Beaverton farm for over 1.3M after miniature train accident

PORTLAND, Ore. (KOIN) — Two grandparents are suing a local pumpkin patch for over $1.3 million after they claim a miniature train ride derailed while they were riding it.

According to a complaint filed on Oct. 14, which was first reported by The Oregonian/OregonLive, Kevin and Deann Burns were visiting Hoffman Farms in Beaverton with their family in 2022 when the incident happened.

The Burns’ were riding the train, Kevin with his grandchild on his lap, when the train malfunctioned and tipped over, the lawsuit claimed.

When the train fell, Kevin said he tried to protect his grandchild and ended up landing on his shoulder in the fall, according to the lawsuit.

The court documents allege that the train was known to fall over from time to time, however, there were no warning signs or devices of caution.

The lawsuit claims that Hoffman Farms was negligent and didn’t due their due diligence to make sure the train didn’t malfunction.

As a result of the indecent, the lawsuit claims that the Burns’ were both injured, with Kevin even needing surgery on his shoulder.

The suit asks for over $1.3 million for medical expenses and economic damages as well as loss of future earnings.

KOIN 6 has reached out to Hoffman Farms for a statement but has not heard back yet.
